Terms of service
The rules governing use of the SOVAELLE website and purchases from our store.
These Terms form a legal agreement between you and the Alberta corporation operating SOVAELLE. Please read them before using the site or submitting an order.
1. Agreement and seller identity
These Terms of Service govern sovaelle.ca and related services, content, accounts, communications, and purchases offered by SOVAELLE.
By accessing the site, creating an account, or placing an order, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the site. Shopify provides the ecommerce platform but is not the seller of SOVAELLE products and is not a party to the contract between you and us.
2. Age and eligibility
You must be at least 18 years old and have reached the age of majority where you live to use the site or purchase. By entering the site or ordering, you confirm that you meet these requirements, can form a binding contract, and are not prohibited by law from receiving the products.
3. Products and lawful use
Our products are intended for lawful adult personal wellness use. Product availability and classification can differ by jurisdiction. You are responsible for reviewing product information, warnings, ingredients, compatibility, and local restrictions before ordering or using a product.
You must not purchase, export, resell, transfer, or use a product in violation of law, a safety notice, a recall, or these Terms. We may limit quantities, restrict destinations, request verification, refuse a transaction, or cancel an affected item when reasonably necessary for legal, safety, fraud, supplier, or platform compliance.
4. Wellness information and medical disclaimer
Website content is provided for general product, wellness, and educational purposes. It is not medical advice, diagnosis, or treatment and does not replace advice from a qualified health professional. Individual experiences vary. Stop using a product and seek appropriate advice if you experience pain, injury, irritation, an allergic reaction, numbness, bleeding, or another concerning symptom. For a medical emergency, contact emergency services.
We do not make a therapeutic, disease prevention, fertility, contraception, infection prevention, or other regulated health claim unless it is expressly authorized for the specific product and market. A product description must be read together with its label, instructions, warnings, and authorized claims.
5. Product information
We work to present accurate descriptions, images, dimensions, materials, ingredients, colors, specifications, and prices. Displays and photography can affect appearance, and packaging or minor product details may change. If information is materially incorrect, contact us and we will provide the remedy required by our policies and applicable law.
Availability is not guaranteed. We may correct errors, update information, limit sales, or discontinue a product. We will not substitute a materially different product without your consent.
6. Accounts
You are responsible for accurate account information, the confidentiality of credentials, and activity conducted through your account. Do not share access with a person who does not meet the age requirement. Notify us promptly if you suspect unauthorized access. We may suspend or close an account when reasonably necessary to protect customers, the store, or legal rights.
7. Orders and contract formation
The display of a product is an invitation to place an order, not a binding offer. You can review and correct checkout information before submitting an order. After submission, we send an electronic confirmation containing or linking to the order details. Receipt of an order does not mean acceptance.
We accept an order when we confirm acceptance, begin fulfillment, or ship the product, depending on the communication and applicable law. We may refuse or cancel an order before acceptance for stock errors, pricing errors, suspected fraud, payment failure, destination restrictions, product safety, legal compliance, or supplier unavailability. If we cancel an amount already paid, we will refund it.
8. Prices, currency, taxes, and charges
Prices are shown in the currency selected for the applicable market. Applicable taxes, shipping charges, and other mandatory charges collected by us are shown before you submit the order. Cross border duties, import taxes, brokerage, or fees not collected by us may be payable by the recipient as described in the Shipping Policy.
We may change prices prospectively. A promotion applies only according to its stated dates, eligibility, exclusions, limits, and code requirements. Unless prohibited by law, promotions cannot be combined or applied retroactively.
9. Payment and verification
You authorize us and our payment providers to charge the selected payment method for the order and related amounts disclosed at checkout. You confirm that you are authorized to use the payment method and that billing information is accurate. We may use payment, address, device, and transaction information to verify an order and prevent fraud.
10. Shipping, returns, and refunds
The Shipping Policy and Refund and Return Policy form part of these Terms. They explain processing estimates, third party fulfillment, discreet packaging limits, delivery issues, hygiene exclusions, defects, cancellations, and refunds. Where a conflict exists, mandatory consumer law prevails.
11. Safe use and care
Follow the product label, instructions, warnings, charging guidance, cleaning instructions, storage requirements, material compatibility information, and recommended use. Inspect a product before each use and stop using it if damaged, unusually hot, swollen, cracked, leaking, corroded, or otherwise unsafe. Keep products and batteries away from children and anyone who cannot use them safely.
Do not modify a product, use an incompatible charger or accessory, share a nonshareable product, or use a topical product with a device or barrier unless compatibility is confirmed. Misuse can damage the product or cause injury and may affect a voluntary warranty, but does not remove rights that cannot legally be limited.
12. Safety reports, adverse reactions, and recalls
Report a suspected defect, injury, adverse reaction, near miss, counterfeit concern, or safety issue to help@sovaelle.ca as soon as possible. Stop use and keep the product, packaging, batch or lot information, and proof of purchase unless immediate disposal is necessary for safety. Do not send intimate images or images showing use.
We may contact you for information needed to investigate, meet reporting obligations, coordinate with a supplier or regulator, or conduct corrective action. Follow recall and safety instructions promptly. A recall remedy may differ from the standard return process.
13. Reviews and customer content
If you submit a review, image, comment, or other content, you confirm that it is truthful, based on genuine experience, lawful, noninfringing, and does not include another person’s personal information without permission. Do not submit nudity, sexually explicit demonstrations, hate, threats, harassment, medical misinformation, illegal content, malware, or deceptive promotional material.
You retain ownership of your content but grant us a nonexclusive, worldwide, royalty free licence to host, reproduce, format, publish, translate, and use it for operating and promoting SOVAELLE, subject to your privacy choices and applicable law. We may moderate or remove content, but we are not required to publish every submission. Incentivized reviews will be identified where required.
14. Acceptable use
You must not use the site to:

violate law, regulation, sanctions, export controls, or another person’s rights;

commit fraud, impersonate another person, submit false information, or interfere with payment or security controls;

upload malicious code, scrape or access the site through unauthorized automated means, reverse engineer, overload, or disrupt the service;

send spam, harvest information, or attempt unauthorized access to an account or system;

upload obscene, exploitative, violent, nonconsensual, self harm facilitating, or otherwise prohibited material; or

copy, resell, or commercially exploit the site or its content without written permission.
15. Intellectual property
The site and its text, design, graphics, photographs, videos, logos, product names, packaging, guides, and other content are owned by or licensed to 2840442 ALBERTA LTD. and protected by intellectual property laws. SOVAELLE and related branding may be trademarks or working marks. No licence is granted except the limited right to use the site for lawful personal shopping and information.
16. Third party services and links
The site may use or link to third party services, including Shopify, payment providers, carriers, reviews, social media, analytics, or other websites. Their services may be governed by separate terms and privacy policies. We are responsible for our selection and use of providers as required by law, but we do not control an independent third party website or its content.
17. Privacy
Our Privacy Policy describes how we collect, use, disclose, retain, and protect personal information and how you can exercise available rights. By using the site, you acknowledge that information will be handled as described in that policy, subject to applicable consent requirements.
18. Disclaimers
To the fullest extent permitted by law, the site and general content are provided on an “as available” basis. We do not promise uninterrupted or error free access. Product warranties are limited to those expressly stated by us or the manufacturer, together with all warranties, conditions, guarantees, and rights that apply by law.
Nothing in these Terms excludes a representation, warranty, condition, guarantee, duty, or remedy that cannot legally be excluded or limited.
19. Limitation of liability
To the fullest extent permitted by law, 2840442 ALBERTA LTD. will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from use of the site, including lost profits or data, when such loss was not reasonably foreseeable or is excluded by valid law.
Where liability can legally be limited, our aggregate liability relating to a product or order will not exceed the amount paid for the affected product or order. This limit does not apply to fraud, wilful misconduct, gross negligence where it cannot be limited, personal injury caused by negligence where liability cannot be limited, breach of mandatory privacy or product safety duties, or any other liability that law does not permit us to exclude or limit.
20. Responsibility for misuse
To the extent permitted by law, you are responsible for reasonably foreseeable loss caused by your unlawful use of the site, material breach of these Terms, infringement of another person’s rights, or unsafe misuse of a product contrary to clear instructions. This section does not make you responsible for our negligence, a product defect, or a duty imposed on us by law.
21. Governing law and disputes
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there, without regard to conflict of law principles. The courts located in Edmonton, Alberta will have jurisdiction, except where mandatory consumer law gives you the right to bring a claim in another forum or applies another law.
Before starting a formal proceeding, contact help@sovaelle.ca and give us a reasonable opportunity to resolve the concern. This informal step does not shorten a limitation period or prevent urgent relief.
22. Changes, severability, and waiver
We may update these Terms prospectively. The Last updated date identifies the current version. Material changes will be communicated as required by law and will not retroactively change a completed order unless permitted and agreed. If a provision is invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions continue. A delay in enforcing a right is not a waiver.
23. Electronic communications
You agree to receive order confirmations, receipts, notices, policy records, and other transaction documents electronically where permitted. Save or print the information provided at checkout and in the confirmation email for your records.
